The Market Court has rejected the appeal filed by Uniresta Oy concerning the tendering of the restaurant services of the Linnanmaa and Kontinkangas campuses.

The Market Court has rejected the appeal filed by Uniresta Oy concerning the tendering of the restaurant services of the Linnanmaa and Kontinkangas campuses.

The higher education institutions, i.e. the University of Oulu and Oulu University of Applied Sciences, decided last October to procure the restaurant services of the Linnanmaa campus from Juvenes Oy and Sodexo Oy. Juvenes was chosen as the service provider for Kontinkangas.

According to the Market Court's decision, the university has not acted in violation of the legal guidelines on public procurement in its procurement.

The Market Court's decision has a 30-day appeal period. There is no direct right of appeal, but leave to appeal should be requested separately from the Supreme Administrative Court. The Market Court's decision is enforceable unless the Supreme Administrative Court orders otherwise.

In the process, the selection criterion was price, but to be included in the price comparison, the tenderers had to meet the high minimum quality requirements.

"The university had to set the price as a selection criterion based on the Market Court's previous decisions. As a university, we have acted in accordance with the law and requirements, even though I understand well the many consequences associated with this decision," emphasises Sanna Pikkujämsä, the university's procurement lawyer.

The Act on Public Procurement obliges the University to put service providers out to tender and to treat the participants in the procurement procedure and other suppliers equally and non-discriminatorily.

The meals of higher education students are subsidised by the meal subsidy paid by Kela. The grounds for subsidising meals for higher education students are laid down in the Government Decree (375/2020).
